How to open a public organization during the war?

Opening an NGO is a relatively simple procedure if all the registration documents are correctly drawn up from the very beginning. In addition, you will need to work with these founding documents in the future. Therefore, so that no one has any questions, it is necessary to prepare and issue them correctly from the very beginning. Registration is carried out by the local department of justice (for the city of Kyiv - the department of justice of the city of Kyiv).

In contrast to the registration of a charitable organization, which can be submitted to a private notary, documents for a public organization are submitted to a state structure, where the appointment of an executor is almost a lottery.

As a result of reviewing the submitted documents, this registrar may think that you have something that does not comply with the law. For example, because you did not state this provision verbatim, as in the law. And a few days after submission, you may find out that you have been rejected. This is not critical, but you will have extra work and wasted time: submit the documents again and wait a few more days.

Number of participants and who can be participants (founders) of the NGO?

At least two founders are required to create an NGO. Necessarily - natural persons. Legal entities cannot be founders of a public organization. Founders can also be foreigners or stateless persons, if their stay in Ukraine is legal. It should be taken into account that foreign individuals need to obtain an identification code in Ukraine (aka the registration number of the taxpayer's registration card) before registration.

Who can be the head of a public organization? What are the options with governing bodies?

The manager can be both a citizen of Ukraine and a foreigner. But a foreigner must first obtain an employment permit. In general, as regards the governing bodies of a public organization, there are several options for their structure. The most common and simplest form is a one-person manager. The position may be called "Director", "Chairman", "President". There can also be a collegial governing body - the Board, Presidium, Directorate - the essence is the same. In addition, a supervisory board can be created if the organization has more than 10 members. But if there are less than 10 people, its creation is not necessary at all.

Distribution of votes in a public organization.

Each member of the organization has one vote and they are all equal. If the charter does not provide otherwise. And the charter may provide for the following: an intricate structure of both management and membership, where there is simple membership, and there is associate membership, where the latter type of membership does not include the right to vote at all. That is, an associated member can be present at meetings, can even express his opinion with the rights of an advisory vote, but the votes of such members are not taken into account when counting votes.

The address of a public organization: is it needed and what does it affect?

A non-profit organization can be registered either in a non-residential premises (office) or at the place of registration (residence) of one of the founders. It affects which tax office the organization will be tied to (depending on the district).
